As of 14 January 2017 the United States Patent and Trademark Office (USPTO) changes its fees for Trademarks. We want to inform you about these changes and make sure that you pay the correct amount, especially if you are not paying online.
The United States Patent and Trademark Office (USPTO) informs, that as of January 14 the trademark processing and service fees are changing. Some fee costs decrease, but most of them are increasing. The USPTO stresses that the fee-change is for a better serving. “We are making these changes to better align fees with full costs, to protect the integrity of the register by incentivizing more timely filing or examination and more efficient resolution of appeals and trials, and to promote the efficiency of the trademark process, in large part through lower-cost electronic filing options.”
USPTO changes Trademark Fees – Overview
Paper filing:
All fees paid for paper filings will increase. The per-class fee for an initial application for registration filed on paper is going from $375 to $600. Fees are increasing anywhere from $75 to $200 (per class, where applicable) for paper filings.
Electronic filing:
The per-class fee for an initial application for registration filed using the regular Trademark Electronic Application System (TEAS) option will increase by $75 to $400. This increase also applies to requests for extension of protection and subsequent designations filed under the Madrid Protocol. 15 U.S.C. 1141e; Madrid Protocol Article 8(7)(a).
The UPSTO is reducing the fee from $150 to $125 per class for a request for an extension of time to file a statement of use that is filed electronically. The fee for filing affidavits under Sections 8 and 71 will also increase from $100 to $125 per class under the new fee rule. Additionally, the processing fee for an application that doesn’t meet the TEAS Plus or TEAS RF filing requirements will increase from $50 to $125 per class.
Trademark Trial and Appeal Board:
A total of 10 TTAB-related fees will be adjusted. Six fees for initiating a proceeding will increase, depending upon whether filed electronically or on paper. Four new fees are established for electronic and paper-filed requests to extend time to file a notice of opposition filed after the initial request. The extension of time to oppose fees are per application rather than per class.
