This Monday, the U.S. Supreme Court made it easier for patent holders to win increased financial damages in court if somebody uses their invention unauthorized.
What are the changes?
The Court decided to discard the Federal Circuit’s strict test for awarding enhanced damages in patent cases.
A test for determining willful infringement, which can allow judges to triple damages awarded to a patent owner, would be too rigid and would allow some egregious infringers to escape their punishment, the justices said. The test had been developed by the U.S. Court of Appeals for the Federal Circuit in Washington, D.C., the nation’s top patent court.
The justices sent cases back to the Federal Circuit in which Stryker Corp. and Halo Electronics Inc. lost their bid for enhanced damages to reconsider it under the new test.
